  • In TravelWeekly Wotif.com CEO Robbie Cooke announced that Wotif.com would have air functionality within six months. I am still trying to figure out what it means for Wotif as a brand to try to shift to air. It is well known that efforts by Expedia's Hotels.com to sell air have been a complete failure. Wotif itself tried to sell land packages back in 2004/5 but found that did not work. I am not able to think of another example of a land product online travel brand successfully adding transport (let me know if you can);
  • From the same article - planned integration savings will be $1.5mm. I don't think that is enough to indicate a shut down of the Travel.com.au Sydney office (Wotif is Brisbane based) butit is big enough to presumably make a few people in that office a little nervous; and
  • In the Australian Webjet MD David Clarke sad he was relieved to have missed out on buying Travel.com.au. Of course one would say that if one was the failed bidder but he is right when he says that the integration efforts that confront Wotif are going to be challenging and by no means guaranteed to work.

Opodo looks good in black - banks Euro 6.6mm in profits

The owners and staff at pan Euro OTA Opodo must be walking around with big fat smiles on their faces (or sitting slumped in their chairs with a look of absolute relief) after having recorded and announced their very first profit. Reports are of a EURO 6.6mm net profit in 2007 off the back of Euro 1.3bb in TTV (well they say sales but presume that is gross bookings). Other stats from the story are 3 mm customers and "double digit growth" 07 over 06.

UPDATE - Travolution are carrying a brief interview with Opodo CEO Ignacio Martos where admitted that the sale of Karavel to Barclays contributed to the net profit number. Does not say how much it contributed. The leak that hit the internet was that the Karavel sale would net Amadeus (who control Opodo) Euro 40mm. So what does this mean. One reading is that maybe taking away the costs of operating Karavel help contribute to the Opodo bottom line. Another (more dangerous reading) is that it was the profits from the sale that pushed Opodo into the black, not general trading activity. No way of telling which until we see broken out numbers but is very interesting to speculate about.

Virginia Supreme Court Expands Availability of Punitive Damages in Corporate Raiding Cases

The Virginia Supreme Court in Banks v. Mario Industries of Virginia, Inc., 650 S.E.2d 687 (2007), http://www.courts.state.va.us/opinions/opnscvwp/1061348.pdf, threw a bone to companies which have lost employees to newly formed competitors by weakening the quantum of proof necessary to demonstrate "actual malice" that would support an award of punitive damages in such situations.

Mario Industries manufactures and sells lighting products in part to hotels, nursing homes and governmental entities. Troy Cook managed its contract sales division from 1995 to 2003. Bette Banks was Mario’s sales rep in Virginia, Maryland and DC and the Darnell Group was a sales organization that acted as Mario's sales rep in Illinois and Michigan during the time in question.

According to the opinion, Cook and another individual who had previously been employed by another Mario company formed Renaissance Contract Lighting and Furnishings, Inc. in March 2003. The business plan prepared for Renaissance contained Mario's confidential information regarding growth rates, sales totals, past projects, target price points for customers, profit margins, vendor lists, key accounts and suppliers, marketing plans and strategies, production costs, commissions, trade secrets and intellectual property. This information enabled Renaissance to become highly competitive with Mario.

The evidence also indicated that Cook spoke to at least three Mario employees while still employed by Mario about Renaissance. And, Cook used his computer at Mario to draft documents relating to the formation of Renaissance. From March, 2003 until he resigned in November 2003, Cook was employed both by Renaissance and Mario. During this time and after he resigned, Cook encouraged other Mario employees to send opportunities to Renaissance. Among those who did so were Banks and Darnell.

Mario brought several lawsuits against all of the above, which were consolidated for trial, under theories of tortious interference with business relations, common law and statutory conspiracy, breach of fiduciary duty, misappropriation of trade secrets and conversion. Mario prevailed at trial on all counts except business conspiracy. In addition to compensatory damages, the jury awarded $56,700 in punitive damages.

One of the most interesting and far reaching aspects of the opinion relates to the quantum of proof necessary to establish actual malice that would support an award of punitive damages. The jury was instructed that "actual malice" is "a sinister or corrupt motive such as hatred, personal spite, ill will, or a desire to injure the plaintiff." The Court held evidence that Cook had formed Renaissance while he was employed at Mario with the intention that it would compete with Mario was sufficient for the jury to conclude that Cook had the requisite malice to injure Mario. Thus, the award of punitive damages was allowed to stand.

This holding is significant because it blurs the line between "actual malice" necessary for the recovery of punitive damages and "legal malice" which is the standard required to prevail under the Virginia business conspiracy statute. As the Supreme Court noted in Advanced Marine Enterprises, Inc. v. PRC, Inc., 501 S.E.2d 148 (Va. 1998), http://www.courts.state.va.us/opinions/opnscvwp/1971950.doc, to prevail under the conspiracy statute, it is not necessary "to prove that a conspirator's primary and overriding purpose is to injure another in his trade or business. (citations omitted) Rather,... these statutes merely require proof of legal malice, that is proof that the defendant acted intentionally, purposefully and without lawful justification." "Without lawful justification" can include breach of fiduciary duty or assisting someone to do so. See Feddeman & Co. v. Langan Associates, 530 S.E.2d 668 (Va. 2000), http://www.courts.state.va.us/opinions/opnscvwp/1991996.doc .

On its face, it would seem that the evidence the Court found persuasive in Banks was more akin to that necessary to establish "legal malice". In many cases, an employee, in an effort to minimize risk, will form a competing company while still employed by the original employer. It now appears, however, that, if that new company is designed to compete with the former employer, such facts are sufficient to allow a jury to find "actual malice" that will support an award of punitive damages. In the context of a statutory business conspiracy suit, this provides a plaintiff with an extra arsenal. Given that punitive damages are available in such a case if there is a separate claim that will support such an award, and are not preempted by the trebling of damages provided in the statute, in the routine case punitive damages may now be a realistic threat.

As a professional network marketer, one of the most important skills to develop is how to present your business opportunity to prospects in a way that will keep them leaning forward instead of scaring them off! Here are a few free mlm help tips you can follow to make this process more enjoyable and stress free.

Step One: The First Call

-Ask your prospect if they done a home business before. This will help you identify if you are dealing with someone who has never done MLM or if they have previous experience.

-Talk with your prospect about the difference between linear and residual income. Explain to them that linear income is what you would get from a full time job where you are paid every 2 weeks. If one wants to make more money, more work needs to be done. If the work stops, the pay stops. Residual income is when you do something right one time and then get paid for the rest of your life.

-Tell your prospect you will teach them the skills they need to gain residual income

-Set an appointment for the second call.

Step Two: The Second Call and More Free MLM Help Tips

-During this second call to your prospect, share your story. Talk about how you became involved in the business and why. This will help your prospects open up to you. They will be almost obligated to do so because you freely shared with them.

-Ask the prospect what their dreams are; if they could do anything do anything, what would it be? The prospect should write down their goals, dreams, and aspirations. Once they are finished, ask them if anything else comes to mind.

-Once the person has explained their dreams and goals, ask if their current income will help them reach them. When you do this, you are putting yourself in the light as someone who can help them find a solution to their problem.

-Begin a discussion on the different ways one can reach their dreams. Examples include the following:

a. Investing. This requires capital and knowledge.

b. Second job. This will take away from your family time, put more stress on your, etc.

c. Start a traditional brick and mortar business. This takes capital, skills, knowledge, etc.

d. Build a network. A network based on residual income which will last a lifetime.

Ask your prospect which of these ideas sound doable.

After you have gone through these steps and if the prospect is still interested, you then use your mlm company’s third party tool such as a conference call, website, brochure, etc. that will explain the business more in detail. A brave new world (or, our answer to FUD)



A flurry of media and market interest in enterprise search makes us glad we're instead focused on the user experience in search. On Monday, January 21, 2008, Microsoft offered to buy FAST Search & Transfer, for $1.2 billion. Coupled with recent multimillion-dollar investments by Intel and SAP in the enterprise search vendor Endeca, these moves suggest the extent to which many are scrambling to fill out their existing enterprise search offering.

Others have taken a different approach. In a moment of deja vu, we discovered that another enterprise search player, Autonomy, has recently circulated a white paper about the Google Search Appliance called "Google in the Enterprise." This new document competes with Autonomy's earlier effort to portray us as something we are not.

Before we clarify some of the significant inaccuracies of this white paper, we'd like to point out that all the market movement in enterprise search hints at what we've known since launching the Google Search Appliance five years ago: The key to coming out ahead lies not in any FUD-fueled sales strategy or multimillion-dollar investment in traditional technology, but in the realization that there's a revolution afoot.

This revolution is making information easier to find, share, and deliver to everyday workers. This brave new world means responding to business demands with products that deploy quickly and update simply, so users can access the information they need to be productive -- all without having to spend a fortune. Low upfront and deployment costs are the name of the game. And searching for information behind the firewall can be as easy and powerful as searching for information on Google.com.

Now on to the fine print. Here are a few corrections to the Autonomy white paper we'd like to make:

1. Comprehensiveness: Autonomy states that the Google Search Appliance "does not index all your critical content." On the contrary, the Google Search Appliance was designed to search all critical content in the enterprise, including file shares, intranets, databases, and real-time business data - all from one simple search box. The Google Search Appliance also comes equipped with on-board content connectors, such as those for SharePoint and Documentum, and the content connector framework, which is a published, open source framework that provides flexibility for anyone -- customers, SIs, ISVs -- to rapidly extend the reach of the Google Search Appliance.

2. Security: The paper states that the Google Search Appliance's "security features are not sufficient for enterprise use." In actuality, the Google Search Appliance provides two levels of security; first, the Google Search Appliance provides out-of-the-box support for multiple security access control systems (such as SAML standards, SSO, NTLM, etc.). Secondly, the Google Search Appliance supports document-level security with all content sources, which ensures that end-users see only those documents in the results list to which they have access.

3. Relevancy: According to hundreds of search relevancy and judgment tests that anyone (competitors or prospects) can run from the National Institute of Standards & Technology, Google's enterprise search precision and relevancy are the highest in the industry. Our relevancy has been put to the test in thousands of enterprise deployments around the world and more than 50% of our customers switched to Google because of our higher relevancy.

4. User Experience: While we couldn't find the words "user experience" anywhere in the Autonomy paper, Autonomy claims that the Google Search Appliance "does not offer the advanced retrieval or automatic information operations required by the enterprise." The Google Search Appliance does offer advanced operations; however, we've made sure to keep interfaces fast and easy to use. According to usability expert Jakob Nielsen, "the search front end should make searching the intranet effortless" and "a company with poor intranet usability would save $3 million per year if it improved its intranet usability to an average level. And a company with average intranet usability would save $2.4 million per year if it improved its intranet to the usability level found in the best 25%." We think he's on to something.

Finally, Autonomy mentions that the Google Search Appliance "capabilities are still being honed." This is certainly true: We are constantly working to improve the appliance, to make sure it offers ever increasing relevancy out of the box. The fact is that we employ thousands of engineers focused on search relevancy and quality. In addition, we are the fastest innovator in the industry. In the last three months alone, seven new Google Enterprise Labs experiments have been launched (by Google, not third parties as Autonomy claimed) to enhance the enterprise search experience.

Although the above list is by no means thorough, we feel it's important to clarify misinformation about enterprise search. Ultimately, it might be better to let our products and our customers from all industries do the talking. It's a brave new world in enterprise search, and we're already deeply engaged in it. CUT OUT LIQUID CALORIES


Soft drinks and high sugar fruit juices will kill your weight loss plan. They contain huge amounts of sugar and calories and are easily consumed since they are in liquid form. A 44 ounce super big gulp of coke contains a whopping 415 calories of pure sugar.

This amount of sugar causes a massive insulin spike and causes you to get hungry very soon after drinking it. By simply switching to diet soda, you can cut a huge amount of excess calories and start losing weight. Although this is a good start, you ideally want to switch to water for your primary liquid source.

Make sure to always check your fruit juices for high amounts of processed sugar. Look on the ingredients list for "high fructose corn syrup" which is another name for sugar and see how high it is on the list. The first ingredients listed usually contain the largest amounts. The majority of fruit juices on the market are nothing more than flavored sugar water.

A great alternative is to buy a good juicer and make your own fruit juice. This will provide the highest level of freshness and nutrients when compared to processed versions. Juicing using real fruit provides the natural source of fruit sugar called "fructose".

Changes on eBay - Don't Panic 'Til You've Done the Math

Did you hear it, the rumbling going through the eBay seller community today? It's been building for a few days, since the news that today would be the Big Announcement with details regarding the restructuring of eBay's fees and feedback policies. If you heard the rumble change to a roar early this morning, that's when the details hit the news - and eBay sellers hit the ceiling.

Fortunately, now that it's afternoon the roar has subsided and even the rumbling has settled down since wise sellers have started doing the math and assessing how the fee changes might actually affect their businesses. Initially lost in the roar was the fact that, after being rumored for some time, the fee for gallery photos indeed will be eliminated. That in itself means a huge savings for sellers who use the gallery photo option and is great news for eBay buyers as hopefully this will make it easier for them to shop (which turns into good news for the seller, who is more likely to make a sale). It seems that most of the sellers who have done the math have figured out that the change in the fee structure will have little effect on their final, bottom line fee. In fact, many who have a low sell-through rate are thrilled that their overall listing fees will be significantly lower.

Of course, there is the feedback issue, the fact that sellers will no longer be allowed to leave neutral or negative feedback for buyers. On the surface that certainly stings but, as I've said before, practice excellent customer service and you should not have to worry about any but the very occasional negative buyer, and there's even a policy to handle and remove those negatives in certain cases. There's a lot to learn about the policies that were announced today. Rather than getting caught up in the hysteria, savvy sellers should study the changes, do the math and then decide how much worse off - or better off - they might be in the long run. Here's an overview of the announcement with links to the details. Read and study, then decide for yourself what changes if any you will need to make in your eBay business to stay a step ahead of the crowd and take advantage of the void to be filled by those disgruntled sellers who jump the eBay ship. Fee changes take effect February 20, so that gives you plenty of time to make any pricing or policy changes of your own that you deem necessary to best serve your customers - and help your business grow.

GigaOM: Yahoo! should change its travel strategy and buy Priceline, Orbitz or Expedia


Yahoo! is in trouble. Stock is down almost a third in the last twelve months, big layoffs are coming (as many as 2,500), CEO Semel is out and many of the senior execs have followed leaving founder Jerry Yang in charge. John Battelle dug up an old quote Nov 2001 that effectively says that Yahoo has been looking for a turnaround strategy for six plus years. Even Kevin May at Travolution is worried.

Sramana Mitra guest editing on GigaOM has a post offering a number of revolutionary solutions (read acquisitions) for each of the major sectors that Yahoo! operate in, including this
"Yahoo has also made a move in online travel, but is not a top performer. Priceline, Expedia and Orbitz are all monetizing the segment. Yahoo should acquire one of them, and become a serious player."
Revolutionary to say the least but Yahoo! actually has a precedent for operating a travel retail business (rather that just a media business). In Japan Yahoo! Travel is an operating travel buseinss (also known as Tavigator) is a joint venture between Yahoo! Japan, JTB (Japan's and one of the world's largest travel companies) and uber Japanese investment house Softbank (itself an investor in Yahoo! Japan).

So we're flashing on every news channel! But whats all the hype about? well its Bird flu this time in Calcutta, from where i belong.. and not a good time for all the calcuttans who are compelled to quit consuming poultry(sigh).. imagine chicken and eggs being excluded from our meals! how cruel is this, just like some curfew, like everything has gone haywire! i cant think of any alternative to replace the taste of poultry and eggs, i cant feed that to baby Alisha who doesn't seem to be interested in any food except eggs! when will the chickens be back safely?

Few days ago West Bengal birds were found to be carrying the H5N1 virus which can cause avian influenza in humans.. WB had appealed to all other states to help cull up chickens suspected of having the disease.19 districts were supposed have been affected, with a population of 24 million.. phew!

Nepal is said have banned poultry imports from India.. Bangladesh fears an outbreak too.

So what is bird flu?
Avian influenza is an infectious disease of birds caused by type A strains of the influenza virus.All birds are thought to be susceptible to the avian influenza, though some species, such as wild ducks, are more resistant than others. Domestic poultry, such as chickens or turkeys, are particularly susceptible.

How does it effect people?
Avian influenza does not normally infect species other than birds and pigs. But humans came down with the bird flu in Hong Kong in 1997, when the H5N1 strain infecting 18 humans, 6 of whom died.

Genetic studies showed the virus jumped directly from birds to humans, and caused severe illness with high mortality.

What are the symptoms, can it be tested and how do you treat it?

A New Internet Marketing Study By The University Of Texas And Chitika Says That Only A Handful Of Popular Blogs Are Making Money Online In High Amounts!

This doesn't mean that all the other small blogs or free blogs aren't making any money online but this is something that you should know as a blogger to see where to seek for examples when looking for successful money making blogs for you to follow their foot steps.

The market study made by the University of Texas and Chitika shows that the 50,000 most popular blogs may have earned around $500 million in aggregate 2006 income.

Chikita which have a blog adverting network of about 12,000 blogs was the source of the research results.

Here are the conclusions:

- The top 1 percent are responsible for approximately 20 percent of the total income.

- The top 5 percent are responsible for approximately 80 percent of the total income.

- And the top 15 percent are responsible for approximately 90 percent of the total income.

As you see blogging is a truly and proven way to make real money online with low or no money at all...

Darren Rowse the editor of ProBlogger a blog that teach how to profit from blogs made a little research about this matter by asking his blog readers how much money are they making from their blogging efforts. Here is what Darren wrote on his blog post name "How Much Money DO Bloggers Earn Blogging" which is have a lot of details about the poll.
"I asked readers to share their blog earnings for the month of October. As usual this poll was a popular one with 3054 responses. I’ve run this survey previously so will compare the results between this and last time I ran it below.

Of this number 857 said that they did not earn any money blogging (28%). This is either because they don’t try to - or they try but fail (next time I’ll ask for clarification around this)."

Future Earnings Guidance, A Leading Indicator of Stock Performance

Apple Inc. (NASDAQ: AAPL), Cisco Systems, Inc. (NASDAQ: CSCO), eBay Inc. (NASDAQ: EBAY), IBM (NYSE: IBM), Intel Corporation (NYSE: INTC) and Microsoft Corporation (NASDAQ: MSFT) are six of the Top 20 Innovators of The Innovation Index.

The Innovation Index closed 2007 with 66% gain, crushing the major U.S. indices.

Even though Apple Inc. kicked Off 2008 with bold new innovations, and Apple delivered outstanding results for the latest quarter beating the analyst expectations, Apple shares are down 36% from their 52 week peak of $202.96. Apple had the best quarter in its history. Further, eBay, Cisco and Intel shares are also down 34%, 29% and 29% respectively from their 52 week highs. eBay, Cisco and Intel all had great quarters as well, and beat the analyst expectations.



Why?

On the other hand, IBM and Microsoft had great quarters as well, and also beat analyst expectations. However, IBM and Microsoft shares are trending up, and are only down 14% and 12% from their 52 week highs respectively. NASDAQ composite is also down, but only 19% from the 52 week high.

Thus, IBM and Microsoft stocks are doing better relative to the NASDAQ and also four innovators.

Future Earnings Guidance

IBM and Microsoft came out with positive, uplifting future earnings guidance for 2008. Their earnings guidance either met or beat the street's expectations. Hence, their stocks are trending up! On the other hand, the street perceived Apple's, Cisco's, eBay's, and Intel's 2008 guidance as weak, and below their expectations. Are Apple, Cisco, eBay and Intel sandbagging, or simply playing the conservative earnings guidance game - under-promise and over-deliver? Or are they taking into account the current economic climate, and simply don't want to over-promise?

It's evident though that even these Top Innovators are not immune to interim stock price fluctuations owing to their earnings guidance. The reality is that these companies will outperform, and show a solid earnings growth. At which point, their stocks will go up. For now, because of their relatively weak outlook, their stocks are battered down. Perhaps they provide an excellent buying opportunity to the prudent, value investor.

BECOME A LEAN MEAN FAT BURNING MACHINE


An important part of your total health and fitness is your nutrition plan. That’s right, what to eat and when. As I have mentioned to you countless times, eat smaller meals more often as apposed to starving yourself or eating a couple of big meals during the day.

Eating smaller meals more frequently stabilizes nutrient oxidization levels, making the body more efficient at burning food. The active person wants to lose weight and maintain lean muscle mass.

Eating 5-7 smaller meals every day will stimulate your metabolism, which burns more calories. Furthermore, nibbling throughout the day prevents long stretches of starvation. Going from noon to 6:00pm without eating usually ends with an enormous supper. This is a very bad eating habit seeing as our metabolism can only handle a certain amount of calories, carbs, fat, and protein in one sitting. Drink plenty of water throughout the day as it is essential for proper digestion, nutrient absorption and chemical reactions.

Here are two sample diet plans, along with pre-post workout supplementation, that will start you on the right track to a healthy, daily nutrition plan. The woman’s sample plan comes in under 1600 calories. The man’s sample plan is approx. 2500 calories.

ONE DAY SAMPLE NUTRITION PLAN FOR WOMEN – approx 1600 calories

MEAL 1
1 ½ oz. oatmeal w/1 cup 1% milk
1 small banana
500 ml of water or coffee

MEAL 2
1 medium orange
500 ml of water

MEAL 3
5 oz turkey
2 slices rye bread
1 tsp of fat-free mayonnaise
1 ½ cups tossed salad w/ 1 tsp low cal dressing
500 ml of water

MEAL 4
1 cup low fat yogurt
500 ml of water

PRE-WORKOUT – (OPTIONAL)

Google Content Network Tips: Optimizing for a content network audience

Recently, we wrote a three part series on the Google content network. Many of you were interested in more optimization advice for the content network, and we're sharing more of those tips today:

On the search network, ads are shown to users who are specifically searching for results using one of your keywords. On the content network, ads are shown to users as they research interests and browse sites that are related to your keywords and ad text. Users on the content network are in a different mindset than users on search, so changes to your keywords, ad text and account structure may be necessary to make the most out of your content network advertising.
  • Create separate search and content campaigns.
    This will allow you to:
    • Optimize your ad groups and ad text specifically for content pages.
    • Target different audiences. If you sell flowers, you may want to create a content ad group to show your ads to couples by targeting pages relevant to them.
    • Use general keywords to strengthen the theme of your ad group, without affecting your search performance.
  • Think about the type of user browsing a web page and write ads to catch that user's attention.
    • It's important for your ad text to relate to the webpage on which it appears. If your target user is going to be on pages related to flowers, mention flowers or closely related products in the ad text.
    • Test multiple creatives and ad formats (text, image, video) in all available sizes to gain better insight into what sort of ads will perform the best for you.
  • Include call-to-action phrases.
    • Phrases like 'Register now," "Get a free quote," and "Call now" can can help set expectations for the person who is about to visit your site.
    • Your call-to-action should be what you consider to be a conversion.
  • Highlight special offers or features available on your site.
    • We've found that advertisers often get higher ROI on the content network when they include product prices in their ads. Prices and special offers can help you stand out from competitors and showcase your best deals.
  • Link your ad to customized landing pages that match the information in your ad text.
    • If your ad highlights a special deal on cell phones, make sure that the ad directs users to the specific cell phone page of your site. And ensure that your landing pages are clear and easy to navigate.
As you implement these tips and those from the previous optimization post, we recommend that you track the performance of your campaigns and iterate to figure out what works well for you.
  • Track the performance of your contextually targeted ads using Placement Performance reports.
    • The Placement Performance report (PPR) provides information on where your contextually targeted ads are showing up and how they are performing.
